Privacy Notice
Introduction
- This Privacy Notice is provided to you by me, Muneeb Akram, the sole Barrister practising from Eadala Chambers.
- This Notice explains how I hold, use and disclose personal data, which is known as processing of personal data. Personal data is information in relation to an identified or identifiable person.
Data Processing and Controlling
- The processing of personal data by me is governed by data protection law, including the General Data Protection Regulation 2016 (“GDPR”) and the Data Protection Act 2018 (“DPA”).
- Where I use the term data controller, I am referring to the person or body that determines the purposes and means of the processing of personal data.
- As a self-employed Barrister, I process personal data in order to carry out my individual professional practice of providing legal services, including advocacy and advisory services, to my clients.
- I am a data controller in respect of any physical papers provided to me in the course of being instructed to provide legal services in a particular case, to the extent that such physical papers contain personal data.
- I am a data controller in respect of any electronic personal data, which is processed by me for the purpose of my individual professional practice. Such electronic personal data, includes personal data held on any electronic device, which I use for my professional practice, personal data in my Chambers’ email accounts and personal data contained in my electronic professional diary.
- I process personal data based on consent, provided a professional or lay client has given consent to the processing of their personal data by me. However, where consent has not been provided to me for the processing of personal data, any processing of that personal data is conducted on the understanding that I have a legitimate interest in conducting my individual professional practice.
- I do not currently employ a clerk and I conduct my own clerking, advertising and other administrative functions. Should I outsource any of these functions to a third party, I shall ensure that such outsourcing is subject to contractual arrangements, which ensure that such third party processes any personal data in accordance with my instructions and, for the avoidance of doubt, as though it were a data controller under the Data Protection Act 2018.
- I am a data controller for data that is processed for the purposes of administering Eadala Chambers. Such data includes data processed for billing and marketing purposes. Marketing data emails shall not be sent except where permitted under the Privacy and Electronic Communications Regulations 2003.
- I may from time to time process data relating to applicant barristers to or prospective employees of Eadala Chambers, if any, which shall be processed on the basis of the legitimate interests of Eadala Chambers and I, in the recruitment and training of new barristers and of prospective new employees of Eadala Chambers.
Your Rights
- You have the right under the GDPR and the DPA to ask me to do any of the following, in relation to your personal data that is held by me:
- to give you access to such personal data;
- to erase such personal data;
- to restrict their processing so that such personal data will only be used for limited purposes, as set out in the GDPR;
- object to the processing of your personal data by me;
- ask for such personal data to be provided to you in a structured, commonly used and machine-readable format.
- The above-mentioned rights are set out in the GDPR and DPA, together with the conditions for the exercise of these rights and any limitations. I may rely on applicable exemptions concerning personal data, including data that is protected by legal professional privilege.
- Should you wish to withdraw consent for the processing of personal data by me, or require me to cease processing or to erase your data, I may be unable to provide legal services to you.
How I collect your data
- You provide me with most of the data I collect. I collect data and process data when you:
- Submit an enquiry for any of my barrister services;
- Instruct me to provide legal or advisory services and send case papers and material to me;
- Complete a survey or provide feedback to me; or
- View or use my website via your browser’s cookies.
How I use your data
- I collect your data so that I can:
- Process your enquiry and instructions to me; and
- Write to you with news, updates, and information about my services.
Marketing
- I would like to send you information and updates about my services, from time to time. Where you have agreed to receive marketing information, you may always opt out of receiving such information, at any future point. Specifically, you have the right to stop me at any time from contacting you for marketing purposes.
- If you no longer wish to be contacted for marketing purposes, please inform me of this preference.
Cookies
- Text files placed on your computer are referred to as “cookies”. Cookies are used to collect standard website log information and website visitor behaviour information. At the point when you visit my website, I may collect information from you automatically through cookies.
